LIMITED WARRANTY

This Limited Warranty is provided by Gutter Gliders, LLC (“Gutter Gliders” or “we”) and applies to the original installation by Gutter Gliders of an entire gutter system, including gutters, hangers, corners, end caps, elbows, and downspouts (collectively, the “Gutter System”).

THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS, WHICH VARY FROM STATE TO STATE.

WE WARRANT THAT DURING THE WARRANTY PERIOD, THE GUTTER SYSTEM WILL BE FREE FROM DEFECTS IN WORKMANSHIP.

WE LIMIT THE DURATION AND REMEDIES OF ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY AND

FITNESS FOR A PARTICULAR PURPOSE, TO THE DURATION OF THIS EXPRESS LIMITED WARRANTY.

SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

OUR RESPONSIBILITY FOR DEFECTS IS LIMITED TO REPAIR, REPLACEMENT, OR REFUND, AS DESCRIBED BELOW IN THIS WARRANTY STATEMENT.

WHAT THIS WARRANTY COVERS

Gutter Gliders hereby warrants that during the Warranty Period (defined below), our installation of the Gutter System will be free from defects in workmanship. This Limited Warranty extends to all workmanship matters and is secondary to any manufacturer warranty provided with the Gutter System. If we are contracted to repair an existing gutter, it is not covered under this Limited Warranty, including but not limited to: resealing leaks, reinstalling fallen gutters, adding hangers, and repitching.

WHAT THIS WARRANTY DOES NOT COVER

This Limited Warranty does not cover:
• Normal structural shrinkage or distortion, electrolysis from contact with existing copper or other dissimilar metals, vandalism, harmful chemicals, vapors or
fumes, misuse, abuse, or chemicals in the air (tiger striping).
• Damage caused by owner abuse, neglect, vandalism, intentional harm, or failure to follow the Gutter System instructions or to perform any preventive
maintenance.
• Natural wear and finish changes due to weather conditions, including wind, rain, sleet, hail, ice, snow, or Acts of God (such as hurricanes, tornadoes,
earthquakes, or other extreme natural events).
• Damage resulting from material expansion or contraction, condensation, or other environmental factors.
• Structural damage to the home due to any Gutter System failure.
• Damage caused by alterations or modifications made by anyone other than a certified Gutter Gliders technician.
• Damage caused by third-party contractors working on the property after installation of the Gutter System.
• Water infiltration behind the gutters due to improperly installed or short roof shingles (less than 1 inch past the drip edge).
• Damage caused by fire, impact from foreign objects, or structural settling of the home.
• Damage caused by pests, rodents, or wildlife.
• Damage related to ice dams, standing water, or overflow due to clogged downspouts or drainage systems.
• Damage to the home unrelated to the Gutter System.
• Other external causes such as accidents, abuse, or other actions or events beyond our reasonable control.

WARRANTY PERIOD

The Limited Warranty is valid for ten (10) years from the completion of installation and our receipt of full payment of the contract amount (the “Warranty Period”). If the customer fails to make payment in accordance with the terms of the contract with Gutter Gliders, this Limited Warranty shall be void and have no further effect. The Warranty Period may be extended for an additional five (5) years with the purchase and installation of an approved gutter guard system by Gutter Gliders within 90 days of the original installation. If the gutter guard system is installed at a later date, an inspection and approval by a Gutter Gliders technician is required before an extension of the Warranty Period is granted.

The Warranty Period is not extended if we repair or replace the Gutter System. We may change the availability of this Limited Warranty at our discretion, but any changes will not be retroactive.

CUSTOMER OBLIGATIONS

To maintain warranty eligibility, you must perform regular maintenance and debris removal from the gutters, downspouts, and drainage pipes. Failure to provide evidence of proper care and maintenance, such as regular cleaning of debris from the Gutter System, may void this Limited Warranty.

Service Charge for Maintenance-Related Calls: If you request a warranty inspection and the inspection reveals that the issue is due to lack of maintenance (e.g., clogged or dirty gutters), a minimum $75 service charge will apply for the inspection.

Any unauthorized alterations, repairs, modifications, or tampering with the Gutter System by the customer or anyone other than a certified Gutter Gliders technician shall void this Limited Warranty.

WHAT WE WILL DO TO CORRECT PROBLEMS

If a defect covered under this Limited Warranty occurs during the Warranty Period, Gutter Gliders will, in our sole discretion, either: (a) repair or replace the affected portion of the Gutter System up to the original aggregate installed footage; or (b) refund the purchase price of the Gutter System. If the entire Gutter System is replaced, this Limited Warranty will be deemed fully satisfied and terminated.

WHAT WE WILL NOT DO

Gutter Gliders shall not repair or replace undamaged portions of the Gutter System, as determined by a Gutter Gliders technician.

MATERIAL WARRANTY

Gutter Gliders will not be held responsible for defects in materials used in the Gutter System. All such claims shall be made by the customer under the material warranty from the manufacturer. Gutter Gliders will provide its customers with contact information for the relevant manufacturer(s) and will assist you in submitting claims under the manufacturer’s warranty, where applicable. The specific coverage and conditions will be governed by the manufacturer’s policies.

HOW TO MAKE A WARRANTY CLAIM

To obtain warranty service, you must notify Gutter Gliders within five (5) days of discovering a defect via phone at (256) 656-4447 and email at contactus@guttergliders.com during the Warranty Period. Claims must include:
• Customer name and address
• Description of the damage
• Location of the issue
• Cause of damage (if known)
• Customer contact information

Failure to report issues within the required timeframe may void this Limited Warranty. A Gutter Gliders representative will respond within five (5) days to schedule an inspection, and we will use commercially reasonable efforts to promptly complete the repairs upon an approved claim. If the reported issue is not covered by this Limited Warranty, we shall have the right to immediately inspect and repair the problem with your written authorization and at your sole expense.

LIMITATION OF LIABILITY

THE REMEDIES DESCRIBED ABOVE ARE YOUR SOLE AND EXCLUSIVE REMEDIES AND OUR ENTIRE LIABILITY FOR ANY BREACH OF THIS LIMITED WARRANTY. OUR LIABILITY SHALL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE DEFECTIVE GUTTER SYSTEM, UP TO A MAXIMUM OF $1,500 PER CLAIM, NOR SHALL WE UNDER ANY CIRCUMSTANCES BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR LOSSES, WHETHER DIRECT OR INDIRECT.

SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

WARRANTY TRANSFERABILITY

This Limited Warranty is extended to the customer who originally purchased the Gutter System and is transferable only to the first subsequent property owner (collectively, “you”). The original customer must have the new owner sign and date the original Limited Warranty and submit it to Gutter Gliders within thirty (30) days of the transfer. An inspection by a Gutter Gliders technician may be required prior to transfer, and an inspection fee may apply. The transferred Limited Warranty will remain valid for the remaining term but cannot be extended beyond the Warranty Period, except as described under the “Warranty Period” section above.

DISPUTE RESOLUTION

The following informal dispute resolution procedure is available to you if you believe that we have not performed our obligations under this Limited Warranty: In the event of a dispute, you must submit a written claim to Gutter Gliders. We have 30 days to respond. If unresolved, both parties shall agree to mediation before resorting to arbitration in the state where Gutter Gliders operates. If pursued, arbitration will be conducted under state-specific laws. All disputes shall be resolved individually (no class actions).

SEVERABILITY

If any provision of this Limited Warranty is found to be unenforceable, the remainder of the Limited Warranty shall remain in effect.

OTHER PROVISIONS

This Limited Warranty does not make us responsible for maintenance items. Our failure at any time to enforce any of the terms or conditions of this Limited Warranty shall not be construed to be a waiver of such provision.
